Please read these Terms of Service carefully before using our website or services. By accessing bodyresetrecovery.com, booking an appointment, purchasing a membership or service, or entering a Body Reset studio, you agree to be bound by these Terms. If you do not agree, do not use our website or services.
These Terms constitute a binding legal agreement between you and Body Reset, located at 8061 Branch Avenue, Clinton, Maryland 20735 (“Body Reset,” “we,” “us,” or “our”). For questions, contact us at info@bodyresetrecovery.com or 240.444.1460.
1. Overview and Scope
These Terms govern your: (a) access to and use of the Body Reset website (bodyresetrecovery.com) and any associated mobile platforms; (b) entry to the Body Reset studio facility in Clinton, Maryland; and (c) purchase or use of any service, membership, package, or retail product offered by Body Reset (collectively, "Services").
These Terms apply to all users, whether you are a Member (someone enrolled in a membership plan) or a Guest (someone who purchases Services on a drop-in or prepaid basis). Additional terms may apply to specific Services and will be presented at the time of purchase.
2. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will post the updated Terms on our website with a revised effective date. Your continued use of our website or Services after any such change constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
3. Services Offered
Body Reset offers wellness and recovery services at our Clinton, Maryland studio. Services currently include, but are not limited to: Cold Plunge Therapy, Infrared Sauna, Targeted (Localized) Cryotherapy, Compression Therapy, Red Light Therapy, Salt Therapy, Percussion Therapy, PEMF Therapy, and Assisted Stretching.
We reserve the right to:
Add, modify, or discontinue any Service at any time
Adjust pricing for Services with reasonable notice
Temporarily close equipment for maintenance, repair, or safety reasons without issuing credits or refunds for that downtime
Refuse or discontinue Services to any individual for any reason not prohibited by applicable law
Services, once used, are non-refundable unless otherwise stated in these Terms.
4. Health Disclaimer and Assumption of Risk
Body Reset provides wellness and recovery services, not medical treatment. Our Services are not intended to diagnose, treat, cure, or prevent any disease or medical condition. The information provided on our website and by our staff is for general informational purposes only and does not constitute medical advice.
By using our Services, you acknowledge and agree that:
Participation in cold plunge therapy, cryotherapy, infrared sauna, and other recovery modalities involves inherent physical risks
You are voluntarily assuming all risks associated with your use of any Body Reset service or facility
You are in sufficient physical health to participate in the Services you select
You have disclosed to our staff any health conditions, medications, or concerns that may affect your ability to safely use our Services
Body Reset makes no guarantees regarding physical, mental, or performance outcomes from use of our Services
Certain Services are not recommended for individuals with specific health conditions, including but not limited to: uncontrolled high blood pressure, cardiovascular or circulatory disorders, pregnancy, Raynaud’s syndrome, neuropathy, open wounds or active skin infections, or serious respiratory conditions. If you have a chronic health condition or are taking prescription medication, we strongly recommend consulting your physician before using our Services.
You agree to complete a health intake form and liability waiver prior to your first session. The waiver is a separate document and is incorporated into your agreement with Body Reset.
5. Eligibility and Minors
Body Reset Services are available to individuals 18 years of age or older. Individuals between the ages of 16 and 17 may be eligible to receive certain Services only if a parent or legal guardian: (a) co-signs the liability waiver and health intake form; (b) accepts primary responsibility for all billing related to the minor’s account; and (c) remains physically present in the studio at all times while the minor is receiving Services.
We do not provide Services to anyone under the age of 16. Body Reset reserves the right to request age verification at any time.
6. Bookings, Cancellations, and No-Shows
Most of our services do not require an appointment. However, appointments are required for cryotherapy and assisted stretching and a 50% deposit is required at time of booking.
Cancellations: If you need to cancel or reschedule a booked appointment for cryotherapy or assisted stretching, please do so at least 24 hours before your scheduled session. Cancellations made within 4 hours of the session start time will be subject to a late cancellation fee of $25.
No-Shows: If you fail to appear for a booked appointment without prior notice, you will be charged a no-show fee equal to 50% of the full retail value of the scheduled session.
Late Arrivals: As a courtesy to all guests, sessions begin and end at their scheduled times. We will not extend your session if you arrive late. To make the most of your visit, we recommend arriving 10–15 minutes early, especially for your first session.
You authorize Body Reset to charge any applicable fees to the payment method on file.
7. Studio Rules and Conduct
Body Reset is a professional wellness environment. All guests and members are expected to conduct themselves respectfully toward staff and other guests at all times. Studio rules will be posted at our facility and are subject to change at our discretion. Studio rules are part of your agreement with Body Reset.
The following rules apply to all visitors:
Complete the required health intake form and liability waiver before your first session
Follow all staff instructions regarding service protocols, safety guidelines, and session timing
Wear appropriate attire as required for each modality (swimwear or athletic wear for cold plunge and sauna; comfortable clothing for compression, red light, and PEMF)
Remove jewelry before using cryotherapy, cold plunge, or infrared sauna services
No pets are permitted in the studio, except registered service animals
No photography or recording of other guests without their explicit consent
Guests who are visibly impaired or otherwise unable to safely participate in Services may be refused admission
We reserve the right to remove any guest from the facility and revoke membership privileges for violation of studio rules or conduct that endangers the safety or comfort of staff or other guests.
8. Memberships
Body Reset offers membership plans providing recurring access to our Services at a discounted rate. By enrolling in a membership plan, you agree to the following:
Automatic Renewal: Your membership will automatically renew each week on your billing date until you cancel or we terminate your agreement. By enrolling, you expressly consent to this automatic renewal.
Billing: You will be charged membership dues on a recurring weekly basis. The amount and credit allocation will be stated in your membership plan at time of enrollment.
Cancellation: You may cancel your membership at any time by providing 30 days’ written notice to Body Reset via email to info@bodyresetrecovery.com or in person at the studio.
Freeze: Membership freezes may be granted at our sole discretion for qualifying reasons (e.g., injury, travel, or medical need). To request a freeze, contact us at info@bodyresetrecovery.com. During an approved freeze, billing is paused. Billing resumes on the originally scheduled date once the freeze is lifted.
Price Changes: We reserve the right to adjust membership pricing on an annual basis. We will provide at least 30 days’ written notice of any price increase before it takes effect.
Non-Transferability: Memberships are personal to you and may not be transferred, shared, or assigned to another individual without our prior written approval.
CONSENT TO AUTOMATIC RENEWAL: BY ENROLLING IN A BODY RESET MEMBERSHIP, YOU ACKNOWLEDGE AND AGREE THAT YOUR MEMBERSHIP WILL AUTOMATICALLY RENEW EACH WEEK AND THAT YOU WILL BE CHARGED THE APPLICABLE MEMBERSHIP FEE UNTIL YOU CANCEL IN ACCORDANCE WITH THESE TERMS. TO CANCEL, YOU MUST PROVIDE 30 DAYS’ WRITTEN NOTICE TO BODY RESET.
9. Founding Membership
Prior to our official opening, Body Reset is offering a limited number of Founding Memberships at a rate that will be locked in for the life of the membership. By reserving a Founding Membership, you agree to the following:
No payment is required until Body Reset opens for business
Founding Membership rates will not be increased so long as the membership remains active and in good standing
If at any time a Founding Member cancels their Membership, their Founding Membership rate is abandoned and renewal will be at regular membership rates
Founding Memberships are subject to all other membership terms in Section 8 of these Terms once billing begins
You may cancel your reservation at any time before Body Reset opens with no penalty and no charge
Founding Membership rates are personal to the original member and are not transferable
Body Reset reserves the right to limit the number of Founding Memberships available. Submission of a reservation does not guarantee a Founding Membership if the allotted spots have been filled.
10. Prepaid Packages
Body Reset may offer prepaid session packages in addition to memberships. Prepaid packages are subject to the following terms:
All prepaid packages are non-refundable once purchased
Credits within a prepaid package expire 12 months from the date of purchase; unused credits are forfeited with no refund
Packages are non-transferable and may only be used by the individual who purchased them
One credit is redeemable for one session unless otherwise stated at the time of purchase
11. Payment and Billing Authorization
By providing a payment method, you authorize Body Reset and its authorized payment processors to charge your card for all fees incurred, including session fees, membership dues, prepaid packages, late cancellation fees, no-show fees, and any applicable retail purchases.
Accepted payment methods include major credit and debit cards (Visa, Mastercard, American Express, Discover). All prices are listed and charged in U.S. dollars.
If a payment fails, we will attempt to notify you using the contact information on file. If a valid payment method is not provided within 10 days of a failed charge, we reserve the right to suspend your membership, deny Services, and/or pursue collection of any outstanding balance, including reasonable attorneys’ fees.
You may revoke your payment authorization in writing (email or in-person) with sufficient notice to allow us to act on your request, typically three business days. Revoking authorization does not relieve you of any outstanding payment obligations.
12. Gift Cards and Retail
Gift Cards: Gift cards are subject to their own terms as stated on the card. Gift card purchases do not constitute a membership enrollment. Services redeemed via gift card remain subject to these Terms in all other respects.
Retail Products: All retail food, beverage, and supplement products are final sale and are not eligible for return or exchange. Merchandise (apparel, accessories) may be returned or exchanged within 7 days of purchase, provided the item is unused, unworn, undamaged, and in its original condition. Returns must be completed at the Body Reset studio.
13. Loss of Personal Property
Body Reset is not responsible for the loss, theft, or damage to personal property brought to our studio or the surrounding premises, including the parking area. You are encouraged to leave valuables at home. Lockers or secure storage, where available, are provided as a courtesy only and do not create any bailee relationship or liability on the part of Body Reset.
14. Your Account
If you create an account with Body Reset, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
You must keep your billing profile and contact information accurate and up to date at all times. Body Reset is not responsible for billing errors or missed communications resulting from inaccurate account information.
15. Text Messaging and Communications Consent
By providing your phone number and opting in through our website, booking system, or other approved channels, you consent to receive SMS text messages from Body Reset. These messages may include appointment confirmations and reminders, membership updates, promotional offers, and general studio communications.
Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any text message. Consent to receive text messages is not a condition of purchasing any product or service from Body Reset. For more information, see our Privacy Policy.
16. Intellectual Property
All content on the Body Reset website and any associated materials - including text, graphics, logos, photographs, videos, and branding - is the property of Body Reset Recovery or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, publicly display, or otherwise exploit any Body Reset content without our prior written permission. Unauthorized use of our intellectual property may result in civil or criminal liability.
17. Third-Party Links and Content
Our website may contain links to third-party websites or services for your convenience. Body Reset does not control, endorse, or assume responsibility for any third-party content, products, or services. Your use of any third-party site is at your own risk and subject to that site’s own terms and privacy policy.
18. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE BODY RESET WEBSITE, ALL CONTENT ON IT, AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. BODY RESET EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BODY RESET DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. NO ORAL OR WRITTEN STATEMENT BY BODY RESET STAFF CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
19. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BODY RESET, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM: (A) YOUR USE OF OR INABILITY TO USE OUR WEBSITE OR SERVICES; (B) YOUR PARTICIPATION IN ANY BODY RESET SERVICE OR ACTIVITY; (C) ANY PERSONAL INJURY OR PROPERTY DAMAGE SUSTAINED DURING YOUR VISIT TO A BODY RESET FACILITY; OR (D) YOUR RELIANCE ON ANY CONTENT PROVIDED ON OUR WEBSITE OR BY OUR STAFF. IN STATES WHERE LIMITATIONS OF LIABILITY ARE RESTRICTED BY LAW, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED.
20. Indemnification
You agree to defend, indemnify, and hold harmless Body Reset, including its owners, officers, employees, agents, and affiliates, from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of our website or Services; (b) your breach of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any intentional act or omission by you that causes harm to another guest, staff member, or the facility.
21. Dispute Resolution
We value our relationship with every member and guest. If a dispute arises, we ask that you contact us directly first by email at info@bodyresetrecovery.com or by visiting the studio so we can work toward a prompt and fair resolution.
Informal Resolution: Both parties agree to attempt good-faith informal resolution of any dispute before initiating formal legal proceedings. We will use reasonable efforts to respond to your concerns within 10 business days.
Binding Arbitration: If informal resolution is unsuccessful, any dispute, claim, or controversy arising from or relating to these Terms or your use of Body Reset’s Services - including disputes regarding the applicability of this arbitration clause - shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration will take place in Prince George’s County, Maryland, or at a mutually agreed location. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: You agree that any arbitration shall be conducted on an individual basis only. You waive any right to participate in a class action lawsuit, class-wide arbitration, or any other representative proceeding.
Opt-Out: You may opt out of binding arbitration by sending written notice to info@bodyresetrecovery.com within 30 days of first agreeing to these Terms. If you opt out, disputes must be resolved in state or federal court located in Prince George’s County, Maryland.
Excluded Claims: The following are not subject to arbitration: (a) claims to enforce or protect intellectual property rights; (b) claims arising from non-payment of fees owed to Body Reset; and (c) claims for emergency injunctive or equitable relief.
22. Governing Law and Venue
These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. For any dispute not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Prince George’s County, Maryland.
23. Electronic Communications and Signatures
By using our website or Services, you agree that electronic agreements, notices, disclosures, and other communications satisfy any legal requirement for written communication. You consent to the use of electronic signatures and electronic delivery of agreements, policies, and transaction records. You waive any right requiring original ink signatures or paper delivery of documents where electronic delivery is permitted by law.
24. Privacy
Your use of our website and Services is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. Our Privacy Policy is incorporated into these Terms by reference. By using our Services, you consent to the data practices described in our Privacy Policy, available at https://bodyresetrecovery.com/privacy-policy/.
25. General Provisions
Entire Agreement: These Terms, together with any liability waiver, membership agreement, and our Privacy Policy, constitute the entire agreement between you and Body Reset with respect to the subject matter herein, and supersede all prior agreements or understandings.
Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms, and the remaining provisions shall remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: Body Reset may assign or transfer these Terms, or any of its rights or obligations under them, without restriction. You may not assign your rights under these Terms without our prior written consent.
Force Majeure: Body Reset shall not be liable for any failure to perform its obligations under these Terms where such failure results from causes beyond our reasonable control, including natural disasters, pandemics, government orders, power failures, or other events of force majeure.
No Agency: Nothing in these Terms creates a joint venture, partnership, employment, or agency relationship between you and Body Reset.
